SEC Releases Spring Rulemaking Agenda

On July 8, the Office of Information and Regulatory Affairs released the Spring Unified Agenda of Regulatory and Deregulatory Actions, which includes an update on rulemaking from the Securities and Exchange Commission (SEC). The update includes the following three rule proposals of interest to fund boards:

  • Cybersecurity Risk Management for Investment Advisers and RICs: October 2024
  • Swing Pricing, Liquidity, and Hard Close for Open-End Funds: Considering reproposal in April 2025
  • Enhanced Disclosures by Certain Investment Advisers and Investment Companies on ESG Investment Practices: October 2024

In addition, the agenda includes the previously mentioned proposal on fund fees, slating that proposal for April 2025.  The dates included serve as a guideline rather than establishing a set timeline for regulatory action.

SEC Chair Gary Gensler commented, “In every generation since the SEC’s founding 90 years ago, our Commission has updated rules to meet the markets and technologies of the times.” He added that the Commission works to promote efficiency, integrity, and resilience of the markets ensuring that they work for investors and issuers.
