SEC Releases Reg Flex Agenda Update
The Securities and Exchange Commission released an update to its Regulatory Flex Agenda which includes dates for anticipated final rules as well as rule proposals the Commission is considering. This agenda is an update from the Spring 2022 agenda (released in July), click here to read the Forum’s blog post covering the release. The release notes anticipated dates for final rule releases, but these dates are not deadlines. Some of the final proposals include:
- Cybersecurity Risk Governance (For funds and investment advisers)- April 2023
- Money Market Fund Reforms- April 2023
- Climate Change Disclosure (Registrants)- April 2023
- Investment Company Names- October 2023
- Enhanced Disclosures by Certain Investment Advisers and Investment Companies about Environmental, Social, and Governance Investment Practices- October 2023
Additionally, the release states in 2023 the Commission may propose rules covering:
- Fund Fee Disclosure and Reform
- Exchange-Traded Products
- Disclosure of Corporate Board Diversity
- Human Capital Management Disclosures
In a statement supporting the SEC’s work, Chair Gary Gensler noted, “I support this agenda as it reflects the need to modernize our ruleset, moving deliberately to update our rules in light of ever-changing technologies and business models in the securities markets.”
