The SEC's Enforcement Division recently created a new Asset Management Unit, which is focused on mutual funds, private funds, and investment advisers. SEC Enforcement Chief Robert Khuzami has stated that the unit has developed several initiatives targeting disclosure, performance and valuation by funds and their advisers. In testimony before the Senate, Khuzami said he anticipates the unit will conduct examinations and investigations of investment advisers and their boards of directors concerning duties under the Investment Company Act.
